Appeal Success in Ashley Down

CSJ Planning Consultants have obtained planning permission for a two storey residential extension, using the new Householder Appeal procedure. CSJ were appointed to advise and negotiate an application that had run into considerable difficult, significant effort was made to find a solution. Careful assessment of the context, which entailed a prominent corner plot, was essential. Andrew Beard, Director at CSJ, argued that the clear outlook to the south and elevated ground to the north would ensure that neighbouring amenity and privacy would not be disturbed. Ultimately all attempts to persuade the Local Planning Authority failed and therefore a concise, robust appeal submission under the new regulations was submitted. The appeal was allowed on 6th February 2014 with no onerous conditions. The appeal success meant that a second planning application submitted as a ‘fallback position’ became surplus to requirements. Andrew Beard commented _“It was very rewarding to advise our client of the appeal success. They were delighted that their initial well though through proposals could now be implemented. It was, however, frustrating that an appeal became necessary. Overall this was a triumph of commonsense and pragmatism”_.
