Consent granted for change of use (A2 to A1) in Weston super-Mare

CSJ have secured planning permission for the change of use of 141 Milton Road, from A2 to an A1 convenience store. Normally, such a change of use could be facilitated using permitted development rights, but a condition attached to a previously implemented planning consent on site stipulated that such a change of use would require the submission of a full planning application. CSJ prepared and submitted a Sequential Retail Assessment to support the planning application that demonstrated that the proposed use of the site was acceptable given its location outside of any of Weston super-Mare’s designated local centres for A1 uses as defined within the North Somerset Development Plan. During the determination period of the application it became evident that the key matter in order to secure consent was to ensure the proposal was not detrimental to highway safety. Working in collaboration with Highgate Transportation, it was demonstrated that the imposition of a condition that limited the length of delivery vehicles that serviced the site, through the provision of a Delivery Vehicle Management Plan, satisfied the six tests of a condition as outlined by National Planning Practice Guidance. Accordingly, planning permission was subsequently granted.
